Terms of Service

These Terms of Service ("Terms") govern your use of SilentSpark ("the Service"), a couples intimacy application operated by Andreas Hubenthal, Adalbert-Stifter-Straße 6, 36199 Rotenburg, Germany ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

We strive to keep the Service available but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind.

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If you are a merchant, a legal entity under public law, or have no permanent residence in Germany, the exclusive place of jurisdiction for all disputes arising from these Terms is the operator's domicile in Germany.

For international consumers, mandatory consumer protection laws and statutory jurisdictional venues of your country of residence remain unaffected by this clause. You may also access the European Commission's Online Dispute Resolution platform here: https://ec.europa.eu/odr.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

We reserve the right to modify these Terms at any time. Significant changes will be communicated through a prominent notice within the application. Continued use of the Service after such changes take effect constitutes your acceptance of the revised Terms.
